While the regulations governing Notary practices can be complex, your practical role is straightforward: to identify signers and act as an impartial witness to the execution of documents. Providing services that step beyond this role — such as offering legal advice, and drafting and explaining documents — is considered the unauthorized practice of law (UPL).
UPL can carry serious consequences for a Notary, including: hefty fines, a suspended or revoked Notary commission, and even conviction for a criminal offense. Therefore, it is critical to understand exactly what constitutes UPL — and how to avoid it.
